San Diego Padres Fan Designed T-Shirt Contest Official Rules
(the "Official Rules")
NO PURCHASE NECESSARY TO ENTER OR WIN.
The object of the San Diego Padres Fan Designed T-Shirt Contest (the "Contest") is to submit an original t-shirt design that may be given away to all fans in attendance at PETCO Park on T-Shirt Night on August 31, 2007.
Eligibility
The Contest is open to legal residents of the fifty (50) United States (excluding Arizona, Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions, and excluding where otherwise prohibited by law, rule or regulation) who are 18 years of age or older at the time of entry (each, a "Participant"). Void where prohibited by law. There are no limits on the number of entries per participant. Employees, officers and directors (including immediate family members and members of the same household) of the San Diego Padres ("Sponsor") and the other MLB Entities and each of their respective subsidiaries, advertising and promotion agencies are not eligible to participate. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions), Tickets.com, Inc., SportsOnEarth, LLC, the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers and employees of the above entities.
Contest Period
Fans may submit an entry during the contest period beginning at 3:00 p.m. Pacific Time ("PT") on February 15, 2007 and ending at 5:00 p.m. PT on May 1, 2007 (the "Contest Period").
On or about May 31, 2007, San Diego Padres staff and other qualified judges (the "Judges") will select the winning entry based on the criteria set forth in the Judging section below.
How to Enter
There are two (2) ways to enter: by mail or online. No other method of entry will be accepted. Limit to five (5) entries per person.
All entries must follow the follow specifications and any non-conforming submission will be disqualified. The winning design will be printed on a white t-shirt.
- Artwork must be limited to 6 colors and should include red, navy blue, sky blue, and sand.
- Design must be Padres related.
- Art must be limited to the front of the t-shirt.
All entries must be either hand drawn or submitted electronically using the appropriate format.
The Online Entry design must be a JPEG, EPS, BMP, or PDF format, no smaller than 720 x 486 pixel height and width. Entries submitted in alternative formats will not be considered and considered to be void. The design may be hand-drawn and scanned, but must be submitted in compliance with these Official Rules.
To be eligible, the content of your submission must not be offensive, defamatory, obscene, violent or destructive in nature in any way, as determined by the Judges in their sole discretion.
In addition, the following information must be provided along with each entry, regardless of method of entry:

7) Submission of artwork.
A) Online Method of Entry:
To enter online, participants may log on to www.padres.com or www.padresbeisbol.com and enter by following the instructions for filling out an online entry form.
After submitting the required information, each Participant will be given an e-mail address to which the Participant must submit one (1) design entry (the design and the information provided by Participant on the game entry page shall together be referred to herein as the "Entry"). Each Participant will also be given a confirmation number which must be included with his or her Entry. By submitting the design with the confirmation number to the e-mail address given to him or her, each Participant will automatically be entered in the Contest. Each Participant will be given the option to receive commercial e-mails from padres.com; however, eligibility to participate in the Contest is not dependent upon a Participant's consent to receive such e-mails.
All information submitted by Participants is subject to MLB.com's Privacy Policy accessible at:
www.mlb.com/NASApp/mlb/mlb/help/mlb_help_about_privacy.jsp. Each Participant must complete all non-optional data requested on the online Entry form. Incomplete Entries are void.

Mail-in entries must be postmarked by May 1, 2007 and received by Sponsor by no later than May 15, 2007. Mail-in entries become the property of the Sponsor and will not be returned.
Judging
The Judges will judge all designs entered in the Contest based on the following criteria: Aesthetic value (50%) and Padres branding (50%), both of which are up to the sole discretion of the Judges.
The Grand Prize described below will be awarded to the Participants who submit the most compelling design as determined by the Judges. In the event of a tie for the Grand Prize, the aesthetic score will be used as the tiebreaker. Any entries that do not comply with these Official Rules will be eliminated from consideration.
Grand Prize
The Participant that is judged to have submitted the best design as determined by the Judges will be Grand Prize winner (the "Grand Prize Winner") and will win the following (the "Grand Prize"):
- Four (4) Padres Toyota Terrace Reserved tickets valid for the Padres home game on August 31, 2007. (seat locations shall be determined in the sole discretion of the San Diego Padres)
- One (1) framed copy of the winning artwork autographed by one (1) or more Padres players to be determined in the sole discretion of the San Diego Padres.
- $250 Gift Card for PETCO Animal Supply Co. stores.
Estimated Retail Value of Grand Prize: $500.
The Grand Prize Winner is fully responsible for any and all applicable federal, state, international and local taxes.
TRANSPORTATION IS NOT INCLUDED. All costs and expenses not specified herein, related to the Prize, including but not limited to lodging, transportation costs, meals, taxes (including income taxes) and gratuities and other expenses incurred by accepting the prize are the sole responsibility of the Grand Prize Winner. All prizes will be awarded. Limit one prize per person, family or household. Grand Prize Winner's companions must be 18 years of age or older, unless traveling with a parent or guardian. All MLB game dates and times are determined in the sole discretion of the Office of Commissioner of Baseball and/or Sponsor, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game, as defined by Major League Baseball, is not played due to weather, an act of God, act of terrorism, civil disturbance or any other reason.
Grand Prize is non-transferable, with no cash redemptions or substitutions except at Sponsor's sole discretion. The MLB Entities will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation of any Major League Baseball game. There will be no substitutions for the Grand Prize except due to unavailability, in which case, a cash prize of equal value to the face value of the Grand Prize will be awarded at the exclusive discretion of Sponsor.
Publication and Assignment of Copyright
By entering the Contest, each Participant agrees that his or her submission is an original work of authorship and he or she owns all right, title and interest in the entry as of the date of submission. By entering the Contest, Participants agree to enter into a Trademark License Agreement to assign all right, title, and interest, including copyright rights, in the entry to Sponsor and the other MLB Entities and grant permission for Sponsor and the other MLB Entities to publish or publicize all or part of their entry, including but not limited to Participant's name, likeness and entry, in whole or in part, for advertising, promotional and trade purposes in conjunction with this and similar promotions in any and all media now known or hereafter developed, in perpetuity, without notice and without further compensation, except where prohibited by law.
Game Administration
Sponsor will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by Sponsor regarding the Contest shall be final and binding in all respects.
General Conditions
By participating in the Contest, each Participant in the Contest accepts and agrees to be bound by these Official Rules, including all eligibility requirements, the MLB.com Privacy Policy and MLB.com Website Terms of Use.
The Grand Prize winner will be notified by e-mail and/or telephone. In the event that the winner does not respond to any such notification within twenty-four (24) hours, a disqualification will result and an alternate winner shall be chosen from among all remaining eligible entries. The Grand Prize Winner will receive Sponsor's Affidavit of Eligibility and Release of Liability and License Agreement (collectively, the "Documentation"), which must be completed, notarized (in the case of the Affidavit) and returned within ten (10) days of receipt. A disqualification will result and an alternative winner will be selected from among all remaining eligible entries if the Documentation is not properly returned within the specified period of time. Refusal or return of the Documentation as non-deliverable will also result in disqualification and cause an alternative winner to be chosen from among all remaining eligible entries.
All federal, state and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of California. Any court of competent jurisdiction sitting within the State of California, San Diego County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules.
The MLB Entities shall not be responsible for lost, late or misdirected online entries, for incorrect, inaccurate or incomplete entry information whether caused by a Participant, equipment, or technical malfunction or for any human error, technical error or malfunctions. Sponsor reserves the right to halt, modify, or suspend the Contest at any time during the Contest Period due to situations beyond the control of the MLB Entities such as work stoppages, acts of God, acts of terrorism, civil disturbances, etc.
The MLB Entities shall not be responsible for typographical or other human or technical errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the Grand Prize winner or the distribution of the Grand Prize. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.
The MLB Entities, their respective parent companies, trustees, subsidiaries, franchisees, licensees, agents, independent contractors and advertising and promotional agencies make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Contest, Grand Prize Winner agrees to hold harmless and fully release Sponsor, the other MLB Entities and each of their respective parent companies, trustees, subsidiaries, franchisees, licensees, employees, agents, independent contractors and advertising and promotional agencies from any and all liability for any injuries, losses, death, or damages of any kind caused by any prize or resulting from the acceptance, possession, quality, use or misuse of any prize, or any portion of any prize or travel related to the receipt or use of any prize.
The Contest is a skill contest designed to increase consumer awareness of and interest in Major League Baseball and MLB.com, the Official Site of Major League Baseball. This Contest may not be used for any form of gambling.
Internet
If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the MLB Entities which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In such event Sponsor further reserves the right to judge the entries received prior such event and award the Grand Prize as of the termination date.
The MLB Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The MLB Entities are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to Participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.
CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR, THE OTHER MLB ENTITIES AND THEIR AGENTS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
All online entries must include a valid e-mail address for the entrant. In case of multiple entries, only the first entry received will be considered. In the event of a dispute as to the identity or eligibility of a winner based on an e-mail address, entries will be declared made by the "Authorized Account Holder" of the e-mail address submitted at time of entry. The "Authorized Account Holder" is the person to whom the Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
Any entry that is incomplete, late or otherwise does not comply with these Official Rules will be disqualified.
In the event that the Contest is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Contest, or to disqualify Participants residing in the affected geographic areas. In such event, the MLB Entities shall have no liability to any Participants who are disqualified due to such an action.
