SAN DIEGO PADRES SEASON TICKET ACCOUNT TITLE POLICY

San Diego Padres season tickets are a valuable investment. In order to optimize benefits to our fans that buy season tickets and protect their accounts from unauthorized changes and activities, the San Diego Padres have established this policy with regard to season ticket accounts. Individuals or entities that have season ticket accounts established in their names may be referred to as season ticket members, season ticket customers, season ticket holders, season ticket fans, members of record, customers of record or holders of record. These terms are synonymous with each other, and refer to individuals or entities that the Padres recognize as having established a season ticket account. The Padres have sole discretion in determining the customer of record and longevity on each account. All payments/credits made towards Season Tickets are considered a nonrefundable deposit. In the event of cancellation, 100% of the previous payments made by the customer will be forfeited.

LIMITATIONS TO SEASON TICKET ACCOUNTS

All tickets, including season tickets, are licenses sold to fans by the San Diego Padres for the sole purpose of viewing the game for which the ticket is valid. The season ticket purchaser is purchasing a series of revocable licenses to use specified seats for specified games. Season tickets are not owned by any purchaser, but are the sole property of the San Diego Padres. The purchaser cannot transfer by any method season seats, benefits, rights or responsibilities to anyone else. The Padres reserve the right to refuse to conduct business related to the season account with anyone other than the season ticket member(s) or authorized agent of record. The San Diego Padres reserve the right to change, add to or discontinue any of its policies, procedures, benefits or privileges, including the renewal of season seats at any time by notifying the season ticket member at the mailing or electronic mail address of record. The Padres reserve the right to cancel a season ticket account or withhold an offer of season ticket renewal for any reason, including non-compliance with policies set forth by the San Diego Padres or objectionable deportment of the customer of record or his/her guests. A refund check will be issued to the season ticket member of record for the paid value of season tickets returned to the ticket office.

MEMBER, CUSTOMER OR AUTHORIZED AGENT OF RECORD

There are only three ways a season ticket account may be established: in the name of an individual or married couple or business (organization). Once established, it cannot be changed or transferred to another individual, married couple or business (organization) or any other entity. For individual or married accounts, the name(s) in which the account has been established are the only member(s) or customer(s) recognized by the San Diego Padres. For accounts in the name of a business or organization, the Padres will recognize one individual (authorized agent) to conduct business on behalf of the customer or member of record, i.e. the business or organization. The agent of record for a business or organization can be changed by following procedures set forth by the San Diego Padres for this purpose.

In the examples, the San Diego Padres would recognize only those names followed by an asterisk (*) as season ticket account customers of record. Any other name listed on the account is irrelevant for purposes of determining account title. The addresses, too, are irrelevant as indicators of account title.

OTHER NAMES LISTED ON AN ACCOUNT

The customer or agent of record may name others to the account by making the request in person or by mail. The others named on the account are referred to as "partners". Partners on an account are implicitly authorized by the customer or agent of record to conduct the following business on the account: pick up tickets or other items that have been ordered by the customer/agent of record on the account, obtain replacement seat passes and obtain a season ticket level Compadres Club card. No other access to the account will be granted by the San Diego Padres, nor is it implied. Making payments to a season ticket account that has been established in the name of another individual or entity is done so as a private arrangement between private parties, and does not establish any rights or benefits of a season ticket customer on behalf of the payer. The Padres neither condone nor prohibit such private arrangements, but would strongly encourage any party willing to pay for the season tickets of a season ticket customer to establish their own season ticket account to begin to accrue the benefits associated with being a season ticket account member.

TRANSFERS/CHANGES TO THE NAME OF THE CUSTOMER OF RECORD FOR INDIVIDUAL & MARRIED COUPLE ACCOUNTS

Although the San Diego Padres do not honor requests to change the customer of record on an account, the following exceptions may apply at the discretion of ticket office management. If none of the exceptions apply, the account will be closed, and the seats reassigned to an existing customer based on account longevity.

 ♦  " In the case of a divorce where the account was held jointly, the Padres may award the seats to the ex-spouse who is awarded the season seats in a divorce settlement. An exact copy of final and legal divorce papers must be presented to the ticket office before the account is transferred to the ex-spouse whose name appears second on the account. The Padres have no obligation whatsoever to the ex-spouse who does not retain the seats. Longevity earned on the account will remain intact.
 ♦  " In the case of the death of a spouse where the account was held jointly, the account will be changed to the name of the surviving spouse. The surviving spouse must present a copy of the death certificate to the ticket office before the account is transferred exclusively to the surviving spouse. Longevity earned on the account will remain intact.
 ♦  " In the case of the death of a customer of record where the account was not held jointly, the Padres will close the account, but transfer the seats to the surviving spouse named on the death certificate. A copy of the death certificate must be presented to the ticket office. A new account will be established since longevity will not be transferred in this case. Season tickets are not the property of the season ticket customer so cannot be treated as such in a will, trust or other property transfer method.

TRANSFERS/CHANGES TO THE NAME OF THE CUSTOMER OF RECORD FOR BUSINESS OR ORGANIZATION ACCOUNTS

Insofar as the Padres do not honor requests to change the customer of record on accounts, there are no exceptions for any account in the name of a business or organization. If a business closes, is sold to another company or individual or does not renew its season tickets for any reason, the account will be closed and the seats reassigned to an existing season ticket customer based on account longevity. The Padres will not agree to transfer the seats to another company, an individual in the company including owners or partners. Season seats are not the property of the business or organization, so it does not have the right to include them as such in the sale, transfer or acquisition of the company.

If a business customer of record changes its name solely for marketing or image reasons, but for all intents and purposes is the same company, the ticket office must be provided with documents that clearly demonstrate that this is case. The Padres ticket office management has sole discretion in deciding whether the name will be changed or the account will be closed.
